This website and our physical retail store are operated by New York Mens of San Jose. The terms cover all visitors, registered users, online shoppers and in-store customers. By browsing our website, placing orders or purchasing merchandise, you agree to be bound by these terms together with our Shipping Policy, Refunds & Returns Policy, Payment Policy and Privacy Policy.

2. Acceptance of Terms

By accessing our site, creating an account, submitting an order or buying products either online or at our San Jose physical store, you acknowledge that you have read, understood, and accept these Terms and Conditions. If you do not agree with any part of these terms, you are not authorized to use our website or make purchases. You must be at least 18 years of age to place orders and enter into a binding purchase agreement.

3. Our Products and Orders

All products sold on our site are men’s formal apparel including suit blazers and dress shirts. We strive to make product descriptions, fabric details, sizing charts, images and color representations as accurate as possible. Minor color differences may exist due to screen display variations, lighting during photography and fabric batches. Such slight differences do not count as product defects.

When you submit an order on our website, it constitutes an offer to buy goods. We reserve the right to accept or decline your order for reasons including but not limited to product unavailability, pricing errors, suspected fraudulent transactions, or failure to verify your payment information. An order is only confirmed once we send you an order confirmation email. We may cancel orders before shipment and issue a full refund if we cannot fulfill your request.

4. Pricing and Payment

All product prices are shown in US Dollars. Prices do not include sales tax and shipping fees unless otherwise stated. We reserve the right to adjust product prices at any time without prior notice. If an obvious incorrect price is displayed on the website due to system error, we may cancel the relevant order before delivery even after you receive an order confirmation.

We accept payment methods listed in our Payment Policy. You authorize us to charge your selected payment method for all items in your order. All transactions are subject to payment authorization and fraud review.

5. Shipping Policy

All shipments follow our official Shipping Policy. Standard order processing takes up to 3 business days. Estimated delivery time after processing is 4–7 business days within the United States. We provide free shipping for eligible orders. Our delivery partner is UPS; oversized suit packages may use truck delivery service. Truck carriers will contact you in advance to schedule delivery and require someone to be present at the shipping address. Orders may be cancelled for full refund before shipment. Once shipped, you cannot cancel directly and must follow our return process after receiving items.

6. Refunds & Returns Policy

All returns, exchanges and refunds are governed by our Refunds & Returns Policy. Customers may apply for return or exchange within 30 calendar days after receiving the package. Returned suit jackets and dress shirts must remain unworn, unwashed, with original tags and packaging intact. Defective, damaged or wrong items shipped by us qualify for our return service. Shipping costs for returns will be assigned to either the store or customer based on the reason for return. Refunds will be issued to the original payment method after we inspect the returned goods, and bank processing times vary by card issuer.

7. Intellectual Property

All content on this website including product photos, text, logos, graphic designs, brand marks, product descriptions and layout are intellectual property of New York Mens of San Jose or our licensed suppliers. You may not copy, reproduce, distribute, modify, resell or use any of these materials for commercial purposes without our written permission. You may not scrape our website content or images for use on other online shops or marketplaces.

8. Limitation of Liability

New York Mens of San Jose shall not be liable for any indirect, incidental, consequential, special or punitive damages arising out of your use of the website or purchased apparel. Our total aggregate liability for any claim related to your order shall not exceed the total amount you paid for that order. We are not responsible for delivery delays caused by weather, carrier disruptions, customs, or information errors provided by you such as incorrect shipping address. This limitation applies to the fullest extent permitted by applicable law.

9. Governing Law

These Terms and Conditions and all purchase agreements between you and New York Mens of San Jose shall be governed by the laws of the State of California, United States, without regard to conflict of law principles. Any dispute arising from your orders or website use will be resolved in courts located within Santa Clara County, California.
